8. PKF China Talk – Industrial Property Rights in Germany and Approval Process for Acquisitions of German Companies

Following the development of the "New Silk Road" and the frequent trade exchanges between China and Germany, the problems of selling Chinese products in Germany start to emerge. On the other hand, a string of acquisition actions of German companies by Chinese investors has also aroused heated discussions in all sectors of German society. In this context, PKF Fasselt, together with the law firm Osborne Clarke, held the 8th PKF China Talk on 19 November 2019. This event was aimed at providing Chinese investors and business decision-makers with important information on the topics: "Industrial Property Rights in Germany: Opportunities and Risks" and "Approval Process for Acquisitions of German Companies: Free Market or Closed Shop?".

In the first part of the PKF China Talk this time, our speaker, Dr. Andrea Schmoll, Lawyer and Partner at Osborne Clarke in Cologne, introduced the fundamental of the industrial property rights in Germany, such as trademark, patent, and copyright. She also explained the steps of getting industrial properties as well as the particular provisions. In the next part, Dr. Fabian Christoph, Lawyer and Partner at Osborne Clarke in Hamburg, provided the comprehensive information and updated regulation of the approval process for acquisitions of German companies, which was followed by a Q&A session.
